Please read the following Terms and Conditions carefully as they tell you how we provide products and services to you. How you may end the contract everything you need to know about the agreement you will enter into once you accept our Quotation to carry out work in your home or business premises.
1 DEFINITIONS
1.1. “The Company Us/We/Our” refers to MHD Plumbing and Heating.
1.2 . “The Customer” shall mean the person or organisation for whom the Company agrees to carry out works &/or supply materials.
2 GENERAL
2.1. MHD Plumbing and Heating has given you a Quotation for the cost of installing central heating and/or plumbing equipment that meets the requirements of your home. Once you have accepted, we will carry out all the works necessary to complete the work described in your specification subject to these Terms and Conditions
3 QUOTATIONS
3.1. Are guaranteed subject to work commencing within 30 days from the date of issue. Should you decide to proceed with the work after that date, The Company reserve the right to change the original price quoted. Any changes will be explained in full. The Company shall only be bound by Quotations given in writing and signed by a duly authorised representative of The Company. The Company shall not be bound by any quotations given orally or in which manifest errors occur.
3.2. Acceptance of Quotations can be made in the email sent.
4 PROVISION OF SERVICES
4.1. The company will carry out the whole of the work specified in the quotation at the price quoted during normal hours, which are between 8am and 5pm Monday to Friday. Any variations or additions requested by you will be subject to an additional charge and may also impact the agreed finish date.
4.2. Your order as accepted is subject to the condition that there must be an adequate gas supply to the dwelling prior to the commencement of the work. Without prejudice to the company’s rights where such supply is not laid to enable work to commence, the company may cancel the contract and shall not have any liability for any costs, loss or damage arising from such cancellation. In certain circumstances, the existing gas rate cannot always be determined. If a new gas pipe is required, this will be charged at our standard hourly rates as set out and will be in addition to the quoted price.
4.3. In the event that during the course of the work Asbestos or any substance of a hazardous or potentially hazardous nature is discovered, the Company will comply with local or national regulations, or other requirements that may need to be observed before work continues. The cost of removing asbestos is not included in the price.
4.4. Where we need to connect new equipment to your existing plumbing or heating system, we will not accept liability for the cost of repairing or replacing parts of your existing system, which subsequently develop faults. In certain situations, we may charge for visits made if your system is faulty or has developed a fault after the installation has been conducted. The company will not accept liability where your central heating system does not function properly because your water supply becomes inadequate or the water pressure becomes invariable.
4.5. The Company accepts no responsibility for any existing installations that are present. This relates in particular but not only to any pipework, radiators and valves, heating valves, pumps, shower pumps, electrical controls and/or bathroom / WC services that might be affected as a result of a conversion from a tank fed system to a sealed system or from power flushing of pipework and radiators. This change to a higher pressure rated system and power flushing although rare, could cause leaks in components. Any cost of repairs for which the Company are not liable for will be charged in accordance with our standard company charges.
4.6. If the Customer requests that an existing appliance be re-installed or moved the Company accepts no liability for any internal leaks or malfunctions, as a direct result of this installation.
4.7. Although every care is taken when taking up carpets, wooden floorboards and other flooring the Company cannot be held responsible for any damage whilst carrying out this work.
4.8. The Company accepts no responsibility for the Chlorination of any water systems, including tanks and distribution pipework.
5 COMPANY CHARGES AND PAYMENT
5.1 Work is usually carried out on an hourly rate, or a fixed price will be given for larger jobs. We have a minimum charge of 1 hour for all jobs. The 1st hour is charged at £78 inc VAT. Thereafter, work is charged in 30-minute increments of £39 inc VAT.
5.2. All charges are clearly laid out within our Quotation. In situations when a Quotation has not and /or cannot be provided (ie, Immediate or Emergency works), then our normal charges apply and are as follows: £78 inc VAT per hour during normal working hours (evening and weekend prices may vary). Additional charges will be applied for the supply of any parts and materials as needed, and these will be clearly laid out on the invoice you receive.
5.3. Materials are charged at the Manufacturers recommended price plus 20% mark up and are subject to VAT. We will use customers supplied materials only where agreed prior to work commencement. However customer supplied materials are NOT covered by are warranty terms and conditions.
5.4. Payment is to be made by either credit, debit card or Bank Transfer.
5.5. The Customer is required to pay for Services and/or Goods within 7 days of receiving an invoice.
6 CUSTOMER OBLIGATIONS
6.1. The Customer will provide access to the Company at the times specified in these Terms and Conditions. You will also be required to provide the necessary service utilities for installation.
6.3.The Customer will apply for, obtain and meet the cost of all necessary approvals and permissions required to complete the Services prior to the commencement of the work.
6.4. If you are a tenant, you may need your landlord’s permission for an installation to be carried out. The company will assume such permission has been granted and shall have no liability for any loss or damage arising from failure to obtain such permission.
6.5. The Customer will take all reasonable steps to ensure that the Company does not sustain any damage or loss to any equipment stored on site.
6.6. The Customer shall be solely liable for any hazardous situation in respect of Gas Safe Regulations or Gas Warning Notice issued.
7 CANCELLATION
7.1. As part of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013: The Customer has a right to cancel this contract starting 14 days from the day this contract is made and to have any deposits returned provided the customer sends the Company an email to [email protected].
7.2. If a customer has agreed in writing to the service being started within the 14-day cancellation period they can still cancel but The Company shall be entitled to payment for all work completed up the date of cancellation.
8 GUARANTEES
8.1. MHD Plumbing and Heating guarantees that the Services and/or Goods will be free from defects in materials and/or workmanship for a period of 12 months from the date that the Services and/or Goods were supplied.
8.2. The boiler has a longer manufacturers guarantee, this will be detailed in your quotation.
8.3. Clause 8.1 does not apply:
8.4. If a fault arises due to any subsequent mechanical or other damage not due to a defect in the Services and/or Goods after risk has passed to the Customer.
8.5. If a fault arises due to wilful damage, abnormal working conditions, failure to follow instructions, misuse, alteration or unauthorised repair, improper maintenance or negligence on the part of the Customer or a third party.
8.6. If the Services and/or Goods are found to be defective in accordance with these Terms and Conditions, then the Supplier shall either repair, re-perform or replace the Services and/or Goods or refund any monies paid for the defective Services and/or Goods.
9 Deposits/Stage Payments
9.1. For jobs between £500 and £10,000, the payment structure is as follows: a 50% deposit is payable upon agreement of the proposal and signature of paperwork, and 50% is payable on completion of work.
9.2. For jobs between £10,000 and £20,000, the payment structure works as follows 50% deposit payable on agreement of the proposal and signature of paperwork,30% payable midway through the project and 20% payable on completion of work.
9.3. For jobs over £20,000, a mutually agreeable payment plan will be implemented.
9.4. On large projects if you require us to be on-site permanently, you will be invoiced weekly.
9.5. Once the customer accepts amendments to proposals for extra work, an invoice will be raised for the total cost of the extra work.
10 OUR POLICY ON FITTING MATERIALS SUPPLIED BY CUSTOMERS
10.1. We prefer to supply our own materials to ensure high-quality and trouble-free installation or repair for our customers. We add a markup to cover various additional services, which may not be immediately apparent when comparing quotes. We understand that it can be tempting to look for bargains online and then hire a tradesperson for labour only, especially when budgets are tight. While we are willing to work with either system, our experience has shown that potential pitfalls should be clarified from the beginning, as opting for cheaper materials may result in unexpected costs. We regret that we cannot accept any costs arising from delays, faults, incompatibility, or other problems related to materials not supplied by us. We only provide genuine, high-quality materials and parts from reputable suppliers with enforceable warranties. We do not purchase from online auctions or refurbished parts sites; all our materials are brand new and of the highest quality. Based on our experience, this significantly reduces project delays, stress, and worry. The table below illustrates potential issues and cost implications that may arise.
The Customer is deemed to have read & accepted the terms and conditions herein when giving instruction to the Company.
